  • Mfantsiman MP robbery case: Police awaits three reports

A Circuit Court in Accra, hearing the robbery case of the murdered Mfantsiman MP, has adjourned the matter to February 8, awaiting three reports from the Ghana Police Service.

The reports include Ballistic examination, fingerprints of the accused persons and analysis of phone calls of the accused persons.

When sitting resumed today, Monday, January 18, Assistant Superintendent of Police (ASP) Fuseini Yakubu, told the Court that the police was waiting for the three reports.

According to ASP Yakubu, the three reports would determine the Police next line of action.

The prosecution announced that the Police had been served with a notice of Alibi filed on behalf of Alhassan Abubakar, but the said Alibi did not indicate the contacts, house numbers and names of the witnesses.

“We need further and better particulars of the witnesses in our investigations,” it said.

On the itemised bill of the phone contacts of the accused persons, the Prosecution said the Police was analysing them, adding that “we need two weeks to get the various reports.”

ASP Yakubu indicated that the Police was going to investigate the Alibi and when granted bail, the accused would interfere with investigations.

He said the Police was following some leads and they (the Police) would not like to disclose anything in court.

Currently, ASP Yakubu said the Police was pursuing one Mohammed, an accomplice who is at large.

Mr Diah Marcellinius, who held brief for Mr Martin Kpebu, for Alhassan Abubakar, admitted that he had filed the notice of Alibi and ready to furnish the Police with details they needed so they could investigate.

Mr Paul Kumi, counsel for Fuseini Alhassan, noted that if the adjournment sought by the Police was “housekeeping”, then it was fair and hoped not a way to keep the accused persons in custody to constitute a breach of their freedom.

He renewed his application for bail, noting that the accused persons had been in custody since October 16, last year.

The defence counsel said there was “no news” on the Ballistic examination.

Mr Kumi noted that the phone calls and the rest had been taken by the Police and there was no way the accused persons would interfere with investigations.

The Counsel said the accused persons were ready to provide sureties to execute their bail.

The accused are: Alhassan Abubakar aka Abu Fulani, Naziru Fudailu Nash, aka SP, Alhassan Mahama Yahaya, aka Mystical Cloud, Amadu Yakubu, Haruna Osmanu, Adam Alhassan, Fuseini Alhassan, aka, Black Smith, and Fred Tetteh, aka, Walace and one Mohammed and others who are said to be at large.

The accused persons are facing various charges of conspiracy to commit crime and robbery.

According to the Prosecution, Alhassan Abubakar, aka, Abu Fulani, was a mobile phone repairer residing at Akwatia Line, Kumasi and Naziru Fudailu Nash, alias, SP, a businessman, living at Aboabo No. 2, Kumasi.

The Prosecution said Alhassan Mahama Yahaya, aka, Mystical Cloud, was unemployed and lived at Dansoman in Accra, Amadu Yakubu, a Mobile Money agent at Mankessim Zongo whiles Haruna Osumanu, was a trader, living at Mankessim.

It said on October 9, this year, at about 0100 hours, Police had information that armed robbers had barricaded a section of the road between Abeaze-Dominase and Duadze on the Mankessim Assufosu highway, robbing commuters of their mobile phones, monies and other valuables.

The prosecution said Police quickly mobilised men and proceeded to the scene but narrowly missed the robbers.

It said at the scene, Police saw a number of vehicles parked on the road with some of the victims who had sustained various degrees of gunshot wounds with one dead.

The prosecution said a body was later identified as the Member of Parliament for Mfantsiman, Ekow Quansah Hayford.

It said two of the victims, one Patrick Asante, a Kia truck driver and Uncle Issah, the MP’s driver, got seriously injured.

The prosecution said the Police cleared the road to restore traffic flow and conveyed the victims to Winneba and Cape Coast Hospitals for medical attention.

It said the body of the deceased Member of Parliament was later deposited at the Saltpond Mortuary pending autopsy.

According to the prosecution, investigations revealed that, the late MP for Mfantsiman filed his nominations form on October 8, this year for re-election and decided to visit four communities in the Taabosom Electoral area namely; Effutakwa, Opim, Takoradi and Duadze.

It said the MP arrived with his campaign team on board a Mitsubishi pickup branded in New Patriotic Party colours and the robbers immediately fired gunshots into the vehicle, bursting the tyres of the vehicle, which eventually stopped after running into a ditch.

The prosecution said the robbers surrounded them and demanded for all their valuables.

The robbers pointed a gun at Stephen Allan and asked whether he was the MP, which he replied in the negative.

Prosecution said Mr. Hayford, the MP owned up so they pounced on him and collected his Samsung galaxy 850 mobile phone and also demanded money.

It said the late MP told the robbers that he had used up all his money as he was returning from a campaign tour.

“He, therefore, pleaded with them to take him to his house to give them money but they refused and shot him, killing him instantly,” the prosecution said.

It said the Police tracked the mobile phone of the deceased to Kumasi and arrested Nash at Aboabo in possession of the deceased Samsung galaxy 850 where Nash mentioned Abubakar as the person who sold the phone to him at GH¢780.00.

The prosecution said Nash led the Police to Akwatia line where Abubakar was also arrested.

Abubakar mentioned Mohammed as the one who sold the phone to him for GH¢680.00, leading to the arrest of Yahaya, Yakubu, Osumanu and Alhassan, in connection with the robbery and murder of the MP.

The prosecution said efforts were ongoing to apprehend Mohammed and other accomplices.

The United Nations Association of Ghana (UNA-GH) has expressed concern about the continuous disrespect of the right to life as an inalienable human right.

“We are of the view that human rights abuse anywhere is human rights abuse everywhere and therefore, we condemn in no uncertain terms, the heinous killing of the Member of Parliament for Mfantseman Constituency, Ekow Kwansah Hayford in cold blood”.

“We extend our heartfelt condolences to the wife, children, the bereaved family, the Mfantseman Constituency, the New Patriotic Party, Parliament of Ghana, the President, and the government for the abrupt truncation of the life of such a flower of youth with sterling human and qualities beyond description for a promising future, “may his soul rest in peace”.

According to the Association, the government must do more to avoid system failure and advocate for enhanced responsible parenting.

“These must be taken very seriously and intensified as part of efforts to overhaul the system, by instilling highly acceptable core values with love from the scratch”.

We believe that the security agencies and the Judiciary would work together for effective and prompt adjudication of matters especially the JB Danquah and Ekow Kwansah Hayford murder cases among the myriad of other equally high-profile ones.

“As an Association, we demand that the perpetrators of these monstrous crimes were brought to justice and the security of all members of parliament and the entire people living in the country were enhanced to the latter .

  • There will be no by-election at Mfantseman constituency

There will be no by-election at the Mfantseman constituency in the Central Region following the killing of the Member of Parliament for the area, Ekow Kwansah Hayford last Friday.

Per Article 112 (5) of the 1992 Constitution, a by-election shall be held within 30 days after a vacancy occurs in Parliament.

That notwithstanding, Clause 5 of Article 112 of the Constitution also states that a by-election shall not be held within three months before the holding of a general election.

Therefore since Ekow Kwansah Hayford died 60 days before the December 7, 2020 general election, there can be no election by mere calculation of the period which is less than three months to the general election.

Media must stop misleading public – Speaker

On the floor of Parliament on Wednesday [October 14, 2020] there was a discussion that some media houses had published that there was going to be a by-election following the killing of the MP.

But reacting, the Speaker of Parliament, Prof Aaron Mike Oquaye  advised the media to desist from misleading the public, reports Nana Konadu Agyeman, who is Graphic Online’s correspondent in Parliament.

The Speaker said the sudden death of the Mfantseman  MP does not automatically pave the way for a by-election.

He said per Article 112 (5) of the Constitution, a by-election shall be held within 30 days after a vacancy occurred.

He said notwithstanding Clause 5 of the Article 112 a by-election shall not be held within three months before the holding of a general election.

“Of course simple calculation tells us that we are not within the three months since the death of our colleague occurred. Therefore, there can be no election by mere calculation,” he said.

Prof. Oquaye who was addressing Parliament said “I would respectfully say that if we do not take care, we will add insults to injury if we become unnecessarily speculative in this kind of situation.”

“And we should all learn to quote from the Constitution itself and seek direction from the Public Affairs and our Legal Department [in Parliament] whenever we want to quote from laws and from the Constitution or make reference,” he said.

    Minority Leader’s concern

Prof Oquaye gave the advice after the Minority Leader, Mr Haruna Iddrisu had raised concern that there were some misleading media information in the public domain arising out of the “regrettably” death of the MP for Mfantseman.

Mr Haruna Iddrisu told the House that some newspapers on Wednesday published stories to the effect that a candidate for a by-election in the Mfantseman constituency had been determined.

Quoting Article 112, he said “Nothwitstanding clause 5 of this article by-election shall not be held within three months before the holding of a general election.”

“So Mr Speaker,  the sudden death of our colleague does not create a constitutional duty for the Electoral Commission to conduct a by-election.

“Because of the time limit, we virtually have 55 days to the elections so the media, if they will endeavor, to desist from further misleading the public. There will no by-election in the Mfantseman constituency,” he said.

The General Secretary of the New Patriotic Party (NPP), Mr John Boadu has confirmed the selection of Ophelia Hayford, the widow of the late Member of Parliament for Mfantseman as a replacement nominee in the 2020 Parliamentary election in the area.

“Yes, it is to a large extent true. I have been to the constituency several times and the whole constituency leadership and party members, the Regional [Executive] setup and the National [Executive] setup deem it fit that his wife [Ophelia] is the back bone of the husband,” Mr Boadu said in a radio interview monitored by Graphic Online Tuesday night [October 13, 2020].

“She knows the constituency very well and considering the large support that the husband had and the kind of difficulties that the constituency is going through, a lot more of the constituents think that we should let the wife continue,” Mr Boadu added in the radio interview which was with Accra based Joy FM.

He added that “there was massive consensus,” and that there was “no descent at all” at all levels of the consideration of the widow as the replacement at the constituency, regional and national levels.

Mr Boadu said the party will formally announce the decision later.

Graphic Online understands that Ophelia Hayford, an Assistant Superintendent of Police (ASP) has since reportedly submitted her resignation letter to the Police Administration.

When Mr Boadu was asked about that in the Joy FM interview, he said yes, that has been done.

Mr Ekow Kwansah Hayford, hitherto, the NPP’s Parliamentary nominee for Election 2020 at Mfantseman in the Central Regional and incumbent MP for the area was killed last Friday by suspected armed robbers.

He had filed his nomination with the Electoral Commission on Thursday, October 8, 2020 seeking re-election in the December 7 election when the unfortunate incident occurred.

In line with Section 4 of the Public Elections Regulations 2020, C.I. 127, which states that: “Where at the close of nominations, but before the election, one of the candidates dies, a further period of 10 days shall be allowed for nominations,” the NPP then initiated the move for a replacement.

  • NPP initiates moves to replace slain MP Ekow Kwansah Hayford in 10 days

The New Patriotic Party (NPP) in the Mfantseman constituency in the Central Region, has initiated moves to find a replacement for Mr Ekow Kwansah Hayford, the party’s Parliamentary nominee for Election 2020 who was killed last Friday by suspected armed robbers.

This is in line with Section 4 of the Public Elections Regulations 2020, C.I. 127, which states that: “Where at the close of nominations, but before the election, one of the candidates dies, a further period of 10 days shall be allowed for nominations.”

The NPP in the Mfantseman constituency is yet to settle on a candidate to represent the late Ekow Kwansah Hayford but is hoping to find one this week to meet the 10 days deadline specified in law.

Ekow Kwansah Hayford who was the Member of Parliament for the area and was seeking re-election filed his nomination forms on Thursday, October 8, 2020 only to be killed the next day.

The EC closed the filing of nominations on Friday, October 9, 2020 same day as the MP was killed at dawn.

As part of the processes for re-election, Mr Hayford battled it out with a new entrant Mr James Korsah-Brown in June 2020 where the NPP delegates endorsed him.

    Replacement

In an interview with Graphic Online’s Central Regional correspondent, Shirley Asiedu Addo, the first Vice Chairman of the Mfantseman constituency, Mr Yaw Berchie-Nuako said the constituency executive would meet by mid week to decide on a nominee and propose same to the national executive for approval.

He said they were hoping that whoever they select will be a winnable candidate to step in the shoes of the late Mr Hayford.

“The constituency executive here are on the grounds and so we know who can win the seat for us,” he stated.

Mr Berchie-Nuako stated that there was no way the national executive could impose any person on the constituency.

Is it going to be Ekow Kwansah’s widow?

Asked if the party was considering bringing the widow of the late MP, Mr Berchie-Nuako did not give a definite answer except to say that the nature of the death was a great blow to the family.

    Korsah-Brown

Asked if the executives would consider Mr James Korsah-Brown the only candidate who had contested the late MP in the primary in June 2020, he said “like I said we don’t have any name yet. The executives would decide and let you know,” he stated.

    NPP will retain seat

The NDC held the seat for 8 years before the NPP’s Ekow Kwansah Hayford snatched it from them in 2016.

“Our late MP was a good man who did a lot of work. His four-year work as MP is far more than the NDC’s work in 8 years,” he stated.

He said any candidate chosen would ride on the excellent works of the late MP.

“We are not going to rely on sympathy votes. The works of Kwansah Hayford speak everywhere and we are optimistic that the NPP will retain the seat,” he added.

He urged NPP members to remain calm and support the family in prayers.

“I was with him when the incident happened and I have still not recovered from it. It has hit us hard but we are praying and know it will make us even stronger,” he added.

  • Central Region Minister wants Mfantsiman MP’s killers nabbed soon

The Central Regional Minister, Mr Kwamena Duncan, has described the killing of Mr Ekow Kwansah Hayford, Mfantseman Member of Parliament, by alleged armed robbers as a ” gruesome, bastardly act that must not go unpunished.”

The visibly distubed Minister, has therefore, tasked the Central Regional Police Commander, DCOP Habiba Twumasi, to quickly get to work and get the attackers to face prosecution.

He said the killing was a blot on the conscience of humanity, explaining, “For someone to look in the eye of a fellow humanbeing and shoot him without any provocation is really sad.”

The 49-year old New Patriotic Party (NPP) MP for Mfantseman, who was seeking re-election, was allegedly killed by armed robbers in the early hours of Friday when he was returning from a campaign trip from the Abeadze Dominase Area in his Constituency.

The MP has been largely described as affable and down to earth by those who knew him.

Speaking with the GNA in an interview on Friday morning, Mr Duncan said,”The news of his loss is very devastating”.

” As a native of Anomabo, Mr Hayford was my direct MP, but more importantly, he was like a real brother and I shared a lot with him. Beside being a party member and a Minister, I was part of his enterprise,” he said.

It was very painful, he said, that the Region had to wake up to such devastating news, especially when Friday, October 9, was the last day for Parliamentary Candidates of the various parties to file their nominations.

Minister Duncan, consequently, advised all Parliamentary Candidates to take their security seriously and never to travel alone, especially in the night.
