    Retired Supreme Court Justice William Atuguba has launched a scathing critique of the New Patriotic Party (NPP), accusing them of using the judiciary as a political shield rather than standing up for justice in the case involving suspended Chief Justice Gertrude Torkornoo.

    Speaking exclusively to JoyNews’ Elton Brobbey on The Pulse, Justice Atuguba dismissed the party’s recent objections to the judicial process for the possible removal of the suspended Chief Justice, Gertrude Torkonoo, as nothing more than strategic self-preservation.

    “You have been overthrown through the ballot. Now your final defence is the Chief Justice? You say, ‘If she falls, we all fall.’ That’s what they are fighting for. It’s not about justice—it’s about survival,” Atuguba declared.

    His remarks come on the heels of a protest organised by the NPP on Monday, where the party publicly opposed efforts to remove Chief Justice Torkornoo. Former Attorney General Godfred Yeboah Dame had also argued it was procedurally wrong for an acting Chief Justice to empanel and preside over a case involving the sitting CJ.

    But Atuguba was unimpressed. “When they [the NPP] were in office, how did they perform? Transparently? Neutrally? In the interest of the people? This is the kind of thing I just hate—pure hypocrisy,” he said.

    The retired judge didn’t stop there. He pointed to former National Security Minister Albert Kan-Dapaah’s admission that judicial decisions are sometimes shaped to avoid national instability. “Yes, that’s an honest man,” Atuguba said. “But if the courts were truly implementing the law, what would make him apprehensive? Public perception? The trend? Repeated unanimous decisions in favour of a particular party?”

    Citing a recent 3–2 decision that broke a pattern of unanimous rulings favouring the NPP, Atuguba raised deeper concerns about the judiciary’s independence under the current regime. “Before that, it was unanimous after unanimous—always in their favour. Is that justice? That’s the democracy they want to entrench?” he asked pointedly.

    Atuguba’s comments cut to the heart of a growing national debate—not just about the fate of a Chief Justice, but about the integrity of the justice system itself.

    Former Supreme Court Justice William Atuguba has disclosed that Speaker of Parliament, Alban Bagbin, is bound by the Supreme Court’s recent ruling on 4 vacant seats in parliament.

    On Tuesday, the Supreme Court nullified the Speaker’s declaration that four parliamentary seats were vacant.

    The Court ruled that the Speaker’s decision to declare the seats vacant was unconstitutional, thereby reinstating the ruling New Patriotic Party’s (NPP) majority in Parliament just before the December 7 election.

    Discussing the implications, Mr. Atuguba stated that the Speaker is obligated to follow the Supreme Court’s ruling, cautioning that failure to do so could lead to contempt charges.

    He highlighted that such contempt is a serious offense, carrying a potential prison sentence of up to 10 years without the option of a fine.

    “There are processes at the Supreme Court…contempt is there…it is a high crime and when its prosecuted you have to suffer imprisonment up to 10 years…[host: that is if the court’s decision is not complied with?]…yes up to ten years. It is not necessarily 10 years. There is no option of a fine but you might just suffer some term of imprisonment not exceeding 10 years. Not only that, a ten year disqualification from holding public office. If you’re a President you are liable to removal from office,” Atuguba expressed.

    William Atuguba expresses disappointment over transfer of vocal Dormaahene

    At a public lecture hosted by Solidare Ghana and the University of Ghana’s Department of Political Science on October 24, 2023, one of Ghana’s highly respected former Supreme Court Justices, William Atuguba, voiced his disappointment regarding the transfer of the Paramount Chief of the Dormaa Traditional Area, Osagyefo Oseadeeyo Agyeman Badu II.

    Atuguba suggested that the transfer of the Dormaahene, who also serves as a High Court judge, is problematic, mainly because of the chief’s outspoken nature.

    He emphasized this point to highlight his concern that the Ghanaian populace might not be adequately vocal about the current state of affairs in the country, which is influenced by the actions of the ruling government.

    “I heard for talking too much, the Paramount Chief of Dormah Traditional Council and a High Court Judge, Osagyefo Agyeman Badu II has been transferred from the Greater Accra to the Volta Region. (Ghanaians are not angry enough),” he said in his speech.

    In his speech, Justice William Atuguba also discussed the necessity of significant changes to the nation’s political system. He warned that if these changes are not made, future administrations would face difficult circumstances.

    “When the Executive needs a reform, the President is changed. When the Legislative needed reform, the Speaker was changed. When the Judiciary needs a reform, the Chief Justice needs to be changed. If Nana Addo could remove the Electoral Commissioner, the Auditor General and it was good, so should John Mahama be able to remove the Chief Justice.

    “We need serious reforms in every institution including the NPP. This is one of the reasons Ghanaians want him to be President again,” he added.

    The public forum was on the theme, “Protecting Ghana’s Democracy: The Role of the Judiciary.”

    Educated people must help the average citizen take charge – William Atuguba

    Former Supreme Court Justice William Atuguba has strongly criticized politicians, emphasizing that they are central to the problems that persist in the country.

    He has urged educated citizens to take a stand and work towards establishing institutions that promote development and safeguard the rights and interests of the average Ghanaian.

    In an interview with TV3 on September 1, 2023, he lashed out at politicians who continued to profiteer off the ordinary Ghanaian: “Are they technocrats…But they would use politics to poison the system.

    “The power belongs to the people, the educated people must help the people to take charge of the country which belongs to them ad benefit from it by putting in place, real and practical institutions that will bring them benefit in their daily lives.”

    He cautioned that contemporary democracy seems to have evolved into a means for some individuals to gain profit at the expense of others.

    He charged politicians to “not be playing tricks with a system I will call democratic and it is an instrument for defrauding the people, impoverishing them and deepening the poison of partisan politics, further and further and further.

    “Our lives now is just you situate yourself politically and get what you can get from it. That is becoming our drive of life in this country,” a visibly disturbed Atuguba added.
