    Joana Gyan has met requirements for December polls – EC

    Deputy Chairperson of the Electoral Commission (EC) in charge of Corporate Services, Dr. Bossman Asare, has announced that Joana Gyan Cudjoe will feature on the ballot for the December 2024 parliamentary elections.

    This development follows the Sekondi High Court’s decision on November 11, 2024, to lift an earlier injunction that had prevented her candidacy.

    Speaking on GHOne TV on Monday, November 18, 2024, Dr. Asare explained that the EC initially disqualified Gyan from contesting the Amenfi Central seat due to the High Court’s injunction.

    However, with the latest court ruling clearing her path, the commission will proceed with the necessary adjustments to reinstate her candidacy.

    “The EC’s position has always been that she was disqualified because of the injunction so once the injunction has been removed, the commission will take the necessary action. The road has been paved for her to be on the ballot,” he said.

    Dr. Bossman Asare emphasized that the Electoral Commission acted within the law by disqualifying Joana Gyan from contesting the Amenfi Central parliamentary elections.

    He further clarified that the EC was a party to the High Court injunction and would have faced contempt charges if it had failed to comply with the court’s ruling.

    “There was an injunction and it was the duty of the political party and the candidate to ensure the injunction was removed. Our position at the EC was that we cannot recognise a candidate who has been injuncted. Those who filed the injunction added the EC were part of the process and so if we had accepted the candidate for the parliamentary election at that particular time, it would mean the EC would be going against the laws of the country.

    “We would have been in contempt of court if we had gone against the ruling of the High Court barring Gyan from presenting herself as the parliamentary candidate. I believe we did the right thing,” he said.

    Background

    The Sekondi High Court, on November 11, 2024, overturned an injunction that had previously barred Joana Gyan Cudjoe from contesting as a parliamentary candidate.

    The issue began when a group of dissatisfied individuals filed a lawsuit, resulting in an interlocutory injunction that temporarily prohibited Joana Gyan from standing as a candidate, despite her decisive win in the May 13, 2023, parliamentary primaries.

    In response, the National Democratic Congress (NDC) nullified the May 2023 election results and held fresh primaries on September 8, 2024, where Joana Gyan once again emerged victorious under the supervision of the Electoral Commission (EC).

    The NDC maintained that the September primaries superseded the annulled May election, solidifying Joana Gyan Cudjoe’s legitimacy as the candidate. However, the EC disqualified her, citing the injunction tied to the voided May 2023 election as the reason for their action.

    The legal team representing Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, has formally appealed against her disqualification by the Electoral Commission (EC).

    The appeal follows the EC’s decision to disqualify Cudjoe based on a pending interlocutory injunction.

    In a letter dated October 15 and signed by Ayine and Associates, Cudjoe’s lawyers argued that her disqualification was unlawful, stressing that she was duly elected as the NDC candidate for the constituency in full compliance with the party’s regulations.

    “We write as lawyers for and on behalf of the National Democratic Congress (NDC) and Joana Gyan Cudjoe, who is the NDC Parliamentary Candidate for the Amenfi Central Consistency for the 2024 Parliamentary Elections (hereinafter called ‘our clients’), on whose instructions we write to you in respect of the above subject matter,” the letter stated.

    The controversy surrounding Cudjoe’s candidacy arose when the EC ruled against her, citing the interlocutory injunction as grounds for her disqualification. However, her legal team argues that this decision lacks merit, as she has the full backing of the NDC and followed all proper election procedures.

    Her legal representatives emphasized that the EC’s actions infringe upon Cudjoe’s rights and disrupt the democratic process within the party. They further argued that any legal matters regarding her candidacy should be resolved without penalizing her as the election date approaches.

    The lawyers highlighted the petition filed on September 13, 2024, which the EC used to justify the disqualification. The petition, followed by a letter on September 24, claimed there was an injunction restraining Cudjoe from holding herself out as the duly elected NDC candidate for the Amenfi Central constituency.

    Despite these claims, Cudjoe’s team maintains that the EC’s ruling is baseless, insisting that she was properly elected and should be allowed to participate in the upcoming December 7 elections.

    The Electoral Commission (EC) has officially disqualified Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for the Amenfi Central Constituency, from contesting in the 2024 general elections.

    This decision follows an Order for Interlocutory Injunction issued by the High Court in Sekondi, dated May 31, 2024.

    In a letter signed by Samuel Tettey, the Deputy Chairman of Operations at the EC, the Commission stated that the injunction was filed in a suit brought against Joana Gyan Cudjoe, the NDC, and the EC by Gyedu Frimpong and four others.

    The court order restrains Gyan Cudjoe from holding herself as the duly elected NDC parliamentary candidate for Amenfi Central, pending the final determination of the case.

    The injunction further prevents the NDC and the EC from recognizing or dealing with her as the official NDC candidate. As the court order has neither been stayed nor vacated, the EC is compelled to comply, resulting in Joana Gyan’s disqualification from the upcoming elections.

    The case in question, titled Gyedu Frimpong & 4 Others v. Joana Gyan Cudjoe, the NDC & the Electoral Commission (Suit No. E12/36/24), has raised legal disputes over Gyan Cudjoe’s candidacy. The injunction remains in effect until the court delivers its final ruling.

    This development significantly impacts the NDC’s preparations for the 2024 parliamentary elections in the Amenfi Central Constituency, as they now face the task of resolving the legal issues surrounding their candidate.

    This belief is often fueled by the noticeable lifestyle changes observed in politicians, including parliamentarians, once they attain power.

    However, not all politicians fit this narrative, as some are already wealthy before stepping into the political arena.

    One such example is Joana Gyan, the newly elected National Democratic Congress parliamentary candidate for the Amenfi Central Constituency, who had amassed considerable wealth prior to her political career.

    In 2022, she received an award from Forbes as the Best Female Miner of the Year, 2021.

    She also received the FIN Gold Woman of The Year award and the FIN Woman Executive Visionary of The Year award in the same year.

    Joana Gyan has stated that her main motivation for entering politics is to make a difference in her community, not money.

    Speaking in an interview on “The Delay Show” in 2020, Gyan disclosed that she earns $700 million annually through the gold export business she owns.

    “I make about $700 million every year, around $65 million per month. My company exports gold… When I started, I was making around $200,000 to $1 million,” she said in Twi when asked about her net worth.

    “I have both small-scale and large-scale gold export licenses… I also have a company involved in mining,” she added.

    The businesswoman and entrepreneur is married to Ghanaian musician Andrew Kofi Cudjoe, a member of the Keche group.

    Joana Gyan is 38 years old and hails from Dunkwa-Offin in the Central Region.
