The Sports Administrative Court (TAD) in Spain has issued a ruling regarding Luis Rubiales’ actions when he kissed Jennifer Hermoso, determining that it does not qualify as a “very serious offence.”
TAD conducted an investigation into Rubiales’ behaviour during the Women’s World Cup final, where he forcefully embraced and kissed Hermoso. According to Marca, a verdict has been delivered, categorising Rubiales’ actions as “serious” but not “very serious.”
FIFA had previously imposed a 90-day suspension on Rubiales, but TAD’s decision now raises the possibility of his return to his previous position as president of the Football Federation in Spain once his ban concludes.
However, it’s worth noting that TAD’s classification of the offence as “serious” could still result in a two-year suspension for Rubiales.
The investigation was conducted based on the old Law of Sport, which was established in 1990. Had the updated rules from 2022 been applied, Rubiales’ actions might have been categorised as “very serious.”
Currently, Rubiales is still under scrutiny by both FIFA and the Spanish government, and it’s uncertain whether additional measures will be taken.
It’s noteworthy that the entire staff of the Spain national team, which won the World Cup, has resigned, with the exception of head coach Jorge Vilda.
His mother was also hospitalised over her refusal to eat in protest of the accusations against him and he has even had his character questioned by his uncle, who labelled him a “cowardly man”.
