Stop acting as NDC PC for Amenfi Central – Court orders Joana Cudjoe Gyan

The High Court in Sekondi, situated in the Western region, has granted an injunction against Joana Cudjoe Gyan, preventing her from representing herself as the elected parliamentary candidate for the National Democratic Congress (NDC) in the Amenfi Central constituency.

This injunction comes in response to allegations of forging her voter’s ID and NDC party card.

Presided over by Justice G. K. Gyan-Kontoh, the court order also prohibits the NDC, the second defendant, from acknowledging or engaging with Joana Cudjoe Gyan as the legitimate NDC parliamentary candidate for the Amenfi Central Constituency.

Additionally, the injunction stipulates that the applicants must submit an undertaking to compensate the respondent for damages if it is later determined that the applicants are not entitled to the injunction.

The five applicants—Gyedu Frimpong, Akubilla Daniel, Wnock Ntiamoh, Isaac Twum, and Doris Aidoo—have filed a lawsuit against Joana Cudjoe, the NDC, and the Electoral Commission as respondents.

The court’s order states: “It is hereby ordered that, until the final determination of the matter, the affected parties are restrained as follows:

The first defendant/respondent is prohibited from holding herself out as the duly elected NDC parliamentary candidate for the Amenfi Central Constituency.

The second and third defendants/respondents, their agents, and officers are prohibited from recognizing, dealing with, or granting any rights or privileges to the first defendant/respondent as the duly elected NDC Parliamentary Candidate for the Amenfi Central Constituency,” the court declared.

“It is further ordered that the applicants shall file an undertaking to pay damages by way of compensation to the respondent if it turns out that the applicants are, in fact, not entitled to the injunction as required,” the court mandated.
