Motor rider jailed 2 years for showing private video of ex-girlfriend

Gilbert Asemuasa, a 24-year-old commercial motor rider in Akatsi, Volta Region, has been sentenced to two years in jail by the District Court for sharing his former fiancé’s private video on social media without her consent.

The convict was found guilty of the offence of Non-Consensual sharing of an intimate video, as stipulated in Section 67 of the Cybersecurity Act 2020 (Act 1038) of the Constitution.

During the court appearance on June 2, Chief Inspector Joseph Ajongbah, the Police prosecutor, provided details of the case. He explained that three years ago, the convict was in a relationship with a 20-year-old woman who had previously attended the Caring Sister Vocational Institute in Keta. In January 2019, the complainant visited the convict at his house, where they engaged in sexual intercourse.

Chief Inspector Ajongba stated that during their encounter, the complainant mentioned experiencing discomfort in her private area. Taking advantage of the situation, the convict secretly used his phone to record the private part of the complainant without her knowledge.

The prosecutor further revealed that the convict had warned the complainant not to end the relationship and threatened to expose her if she did. However, after a dispute, the complainant decided to break up with him. Subsequently, she received a threatening phone call, which she later discovered was from the convict, who intended to expose her by sharing the intimate video.

The complainant reported the matter to the convict’s brother, but no action was taken. Eventually, she lodged a formal complaint with the police in Akatsi, leading to the arrest of the convict. During the interrogation, he admitted to recording the video but denied sharing it on social media.

Following investigations, the convict was charged, arraigned, and subsequently convicted of the offence. The court, presided over by Mrs. Felicia Gandedzi, sentenced him to two years of imprisonment with hard labor after he confessed to the crime.
